Terms + Conditions

Effective Date: January 1, 2019

These Terms & Conditions ("Terms") govern your access to and use of Simple Sweet Sites, Inc. ("we," "us," or "our") services, including consultation, design, and website transfer services. By engaging our services, you agree to these Terms.

1. Services Overview We provide website design services, including an initial consultation, project planning, design execution, and final file transfer. Our standard process includes:

Free Consultation: A 15-minute consultation to discuss project goals.

Deposit: A 50% non-refundable deposit is required to begin the project and secure your place on our design schedule.

Content Gathering: A structured process to gather necessary content and materials.

Brainstorm Meeting: A collaborative session to refine design concepts and expectations.

Design Process and Draft Submission: Creation of the initial draft for review.

Design Approval: Client approval of the final design before domain connection.

Domain Connection: Finalization of the website with the client’s chosen domain.

File Transfer: Transfer of the completed website design to a Wix account registered by the client.

2. Payment Terms

Deposit: A 50% non-refundable deposit is required to begin the project.

Balance: The remaining balance is due upon project completion. Upon payment, the website design file will be transferred to the client’s registered Wix account, giving them Owner/Admin rights to the site.

Refund Policy: The deposit is non-refundable. If a project is canceled, any costs incurred by Simple Sweet Sites, Inc. during the project must be reimbursed by the client.

Payment Methods: We accept credit card payments and check for deposit and balance payments.

3. Client Responsibility for Content Review and Approval

Content Review: It is the client's responsibility to review and approve all content, copy, and design elements provided by Simple Sweet Sites, Inc. before final approval.

Errors: The client assumes responsibility for the quality and accuracy of any content provided to Simple Sweet Sites, Inc., including, but not limited to, grammatical errors, photography/video quality, and design layouts. Simple Sweet Sites, Inc. is not liable for errors found after printing or reproduction through a third-party service selected by the client.

4. Confidentiality We are committed to keeping all client information confidential, as outlined in the contract each client signs at the beginning of a project. Simple Sweet Sites, Inc. will not share, sell, or disclose client information without express permission, except as required by law.

5. Intellectual Property

Ownership of Content: Upon full payment, ownership of the completed website content is transferred to the client.

Proprietary Templates: We retain rights to any proprietary templates or tools used in the project but provide the client full access and ownership of the finalized design.

6. Limitations of Liability

Performance and SEO: We do not guarantee specific performance levels or SEO rankings. Additional SEO services may be purchased if desired.

SSL Certificates: It is the client’s responsibility to purchase an SSL certificate through their domain provider.

Accessibility: Clients may inquire about and purchase accessibility add-ons. Simple Sweet Sites, Inc. does not guarantee compliance unless services are explicitly purchased.

Maintenance: Post-project, the client is responsible for maintaining the website’s content, security, and functionality. We do not monitor website details or make updates unless the client submits a post-project maintenance request.

7. Modifications and Maintenance

Post-Project Modifications: After project completion, any additional modifications are charged at a rate of $60 per hour, or through a monthly maintenance plan as discussed on a case-by-case basis.

8. Termination and Cancellation

Project Cancellation: If the client cancels a project, the 50% deposit remains non-refundable. Additionally, any project-related expenses incurred by Simple Sweet Sites, Inc. must be paid by the client, in line with our pre-pay and bill structure.

Contract Agreement: All clients must sign a contract at the start of the project, which aligns with the terms outlined here.

9. Disclaimers

Warranties and Edits: We strive to provide high-quality services and welcome clients to reach out if they notice any minor errors or need small adjustments post-project. We will gladly address reasonable requests within this scope. However, more extensive edits or changes to the completed design are subject to our standard modification rate or maintenance plan.

Liability Limitation: To the fullest extent permitted by law, Simple Sweet Sites, Inc. is not liable for any indirect, incidental, or consequential damages arising from or related to our services, even if we have been advised of the possibility of such damages.

 

10. Modifications to Terms: We reserve the right to update these Terms at any time. Continued use of our services after such modifications constitutes acceptance of the updated Terms.
